UNHCR’s Procedural Standards for RSD under UNHCR’s Mandate

The following is a RSDWatch summary and analysis of UNHCR’s Procedural Standards for Refugee Status Determination under UNHCR’s Mandate, published by UNHCR in September 2005.  All references (i.e. section x.x) are to these Standards, unless otherwise noted.

 

Right to an interview

 

UNHCR’s standards for RSD procedures provide:

 

“All Principal Applicants must have the opportunity to present their claims in person in an RSD Interview with a qualified Eligibility Officer. Under no circumstances should a refugee claim be determined in the first instance on the basis of a paper review alone.” (section 4.3.1)

 

UNHCR’s standards also state:

 

“Under no circumstances should claims believed to be manifestly unfounded be

decided on the basis of a document review alone.” (section 4.6.4)
